CK AutoHire Limited – Terms and Conditions of Hire.

 

In these Terms and Conditions:

 

It is hereby declared and agreed that the Insurance Policy is only to cover the Hire Vehicle whilst let out on hire, subject to the terms and conditions of the following policy.

 

1. Definitions

A) “Company” means CK AutoHire Limited.

B) “Hirer” means the person, or organisation renting the vehicle.

C) “Authorised Driver(s)” means the driver(s) approved and recorded by the Company.

D) “Hire Vehicle” means the vehicle provided for hire.

E) “Hire Period” means the agreed rental duration.

F) “Insurer” means the insurance provider covering the vehicle.

G)“Insurance Policy” means the policy under which the Hire Vehicle and any third party is insured against any damage caused by the Authorised Driver(s).

H)“Full Weather Equipment” means the hood, side-screens and any other equipment supplied by the Company to the Hirer with a view to protect the Hire Vehicle in the event of weather conditions that may result in damage to the interior trim.

 

2. Vehicle condition & Return

The Hire Vehicle will be supplied in good mechanical and cosmetic condition with a full tank of fuel.

 

The Hirer agrees to:

  • Return the vehicle in the same condition provided at the start of the rental agreement. 

  • Return all accessories and full weather equipment in the same condition at the start of the rental agreement.

  • Return the vehicle with a full tank of fuel.

 

The company reserves the right to charge for:

  • Cleaning

  • Damage

  • Missing items

  • Refuelling

  • Late return

 

3. Permitted Use

The Hire Vehicle may only be used for:

  • Driving on public roads within the United Kingdom.

  • Social, domestic and pleasure purposes only.

 

The Hire vehicle must NOT be used for:

  • Racing, track days, or competitions 

  • Hire or reward Purposes

  • Carrying of hazardous or dangerous goods

  • Any illegal activity

  • Driving under the influence of alcohol or drugs

 

4. Security and Care of the Vehicle 

The Hire Vehicle is equipped with an Anti-Theft Immobiliser, and the activator key must be always kept by one of the Authorised Driver(s) on his or her person when the vehicle is left unattended.

 

The Hirer is responsible for the security of the vehicle at all times.

 

The Hirer must

  • Lock the vehicle when unattended

  • Always keep keys secure

  • Use any supplied security devices

  • Erect weather protection where required

 

The Hirer is fully responsible for any loss or damage caused by negligence.

 

5. Insurance and Liability

Insurance is included for Authorised drivers, subject to insurer terms.

 

Excess
The insurance excess is £1,500.
The Company is not responsible for the first £1,500 of any claim.

Hirer Responsibility
The Hirer is responsible for any loss or damage to the Hire Vehicle during the hire period.

The Hirer shall be liable for any loss or damage to the Hire Vehicle, however caused, until the vehicle keys are returned in person to a representative of the Company.

The Hirer is liable for:

  • The insurance excess

  • Any damage not covered by insurance

  • Loss of hire income while the vehicle is unavailable

  • Administrative, recovery, and repair costs.

 

Important

  • Failure to comply with insurance requirements (including driver checks and eligibility criteria) may invalidate insurance.

  • In such cases, the Hirer will be fully liable for all costs, claims, and damages.

 

6. Security Deposit

A refundable security deposit of £1,500 is required.

  • This sum will be refunded when the Hire Vehicle is returned in a satisfactory condition to the Company. The Hirer undertakes to return the Hire Vehicle to the place and on the date set down on the Hire agreement form with all tyres, tools, sat-nav equipment, full weather equipment and other accessories present and in the same condition as when received.

 

The £1,500 deposit may be retained (in full or part) to cover any of the below:

  • Damage

  • Insurance excess

  • Cleaning

  • Late return

  • Additional charges

 

Further specifications below:

A) The Company’s Insurers apply a £1,500 excess to any claims on the Insurance Policy. The Hirer will be responsible for that sum as part of any claim arising during their period of hire. Damage for which the hirer is responsible includes in addition to collision damage, any damage however caused to any part of the car. This includes damage to engine sump, oil system, wheels, tyres, windscreen, interior and any subsequent damage caused by overheating or loss of oil during the hire period.

B) The hire charge includes vehicle insurance in respect of the Authorised Driver(s). Neither the Company nor its Insurer will accept any liability for loss or damage caused while the hire Vehicle is rented to a Hirer who does not comply with the conditions set out in these terms and conditions and the Insurance Policy, and the Hirer agrees to make any payment necessary to put the Company in the position it would have been if the breach had not occurred. The Hirer will supply any information concerning the Authorised Driver(s) of the Hire Vehicle to the Company upon demand and undertakes to allow the company direct access to the Authorised Driver(s) of the Hire Vehicle and will fully co-operate in obtaining such access. In the event of an insurance claim, the Hirer shall be liable to forfeit his/her deposit.

 

7. Cancellations

We understand that plans can change.

  • Cancellations made more than 24 hours before hire may be rescheduled.

  • Bookings may be moved to a future date within 12 months (subject to availability).

  • No monetary refunds will be issued except where required by law.

8. Charges and Mileage

  • The Hirer must pay the appropriate hire charges to the Company prior to taking possession of the Hire Vehicle. Payment must be by an approved Credit / Debit card or BACS.  

  • Daily mileage allowance: 120 miles per day.

  • Additional mileage: £0.65 pence per mile. This must be paid when the Hire Vehicle is returned.

  • Hire Vehicles are rented at the daily rate agreed at booking.

  • The vehicle must be returned at the agreed time. Late returns may be charged at a rate equivalent to an additional day’s hire.

  • All charges are subject to applicable taxes and levies as required by law.

9. Driver Eligibility

Drivers must:

  • Verify the identity and address of all Authorised Driver(s), a driving licence alone is not sufficient.

  • Supply at least two separate proofs of address in addition to the driving licence.

  • Be aged 30 to 75 years of age.

  • Hold a full valid UK Driving Licence.

  • Have held a license for a minimum of 2 years.

 

Further specifications below:

  • Persons who have not been convicted of an offence in connection with the driving of a motor vehicle or motorcycle and/or have had their driving licence endorsed or suspended with current endorsements showing more than six (6) points.

  • Persons who have not, whilst driving, have been involved in more than one accident during the last 3 years.

  • Persons whose driving licence is not subject to restrictions due to mental or physical disability or infirmity.

  • Persons who do not suffer from fits, diabetes, any heart complaint and/or any other medical condition which is likely to impair their ability to drive the Hire Vehicle safely.

  • Persons who have not had their insurance declined and/or renewal refused and/or special insurance terms imposed and/or have had an insurance policy or cover cancelled by any motor insurer.

 

The Hire Vehicle shall be driven only by the Authorised Driver(s) whose names are on the proposal form completed by the Hirer immediately prior to the hire.

 

10. Accidents & Claims

In the event of an accident or damage, the Hirer must:

  • Notify the Company immediately

  • Inform the police where required

  • Not admit liability

  • Provide full cooperation with insurers

Failure to follow this procedure may result in full liability.

The Hirer agrees to cooperate fully with the Company and its insurers in relation to any claim or incident. This includes providing information, signing documents, and assisting in any legal process if required.

11. Fines & Penalties

The Hirer is responsible for all fines and penalties incurred during the hire period, including but not limited to parking fines, speeding offences, and bus lane violations.

The Company may charge an administration fee for handling fines.

12. Personal Property

Any personal property left in the Hire Vehicle is at the Hirer’s own risk. The Company accepts no responsibility for loss or damage to such items. The Company accepts no responsibility for loss or damage.

 

13. Data Protection

The Company may share Hirer details with:

  • Insurers

  • DVLA

  • Law enforcement

  • Debt recovery agencies

All data is handled in accordance with applicable data protection laws.

14. Termination

The Company reserves the right to terminate the hire immediately if:

  • These Terms are breached

  • False information is provided

  • The vehicle is misused

15. Limitation of Liability

The Company shall not be liable for:

  • Indirect or consequential losses

  • Loss of income or opportunity

Nothing in these Terms excludes liability for death or personal injury caused by negligence.

16. General Legal

  • These Terms are governed by the laws of England and Wales.

  • The Hirer and any Authorised Driver(s) are not agents, employees, or representatives of the Company.

  • The Company does not waive any of its rights under these Terms unless this is confirmed in writing by an authorised representative.

  • These Terms represent the entire agreement between the parties and replace any previous agreements or understandings.

  • Nothing in this clause limits liability for fraud.
